Returns policy

Dear customer, if you have found yourself on this page, it means that most likely something has gone wrong in the processing of your order and you are not satisfied with your purchase. However, there is no reason to be upset! Our company respects your rights. Below, we have included information that will allow you to quickly and conveniently make a complaint or return the goods as a withdrawal.

§1 INFORMATION ON EXERCISING YOUR RIGHT OF WITHDRAWAL.

In our shop you have 14 days to return the products you have purchased. Without any questions on our part.

The withdrawal period expires after 14 days from the day on which you have taken possession of the goods or on which a third party other than the carrier and indicated by you has taken possession of the goods.

To exercise your right of withdrawal, inform us (Przedsiębiorstwo Handlowe EWIMAX Stasiński Mariusz Jana Kasprowicza 24, 64-330 Opalenica) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).
We do not accept parcels with returns that have been sent to us COD.

To meet the withdrawal deadline, it is sufficient for you to send your information concerning the exercise of your right of withdrawal before the withdrawal period has expired. In the event of withdrawal from this contract, we shall reimburse all your payments, including the costs of delivery of the goods, without delay and in any event not later than 14 days from the day on which we are informed of your decision to exercise your right of withdrawal from this contract. We will also reimburse your transport costs, with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest delivery method appropriate to the type of item offered by our company. We will refund your payment using the same means of payment used in the original transaction, unless you expressly request otherwise or we ask you to provide an account number for the refund. - In any event, you will not incur any fees in connection with this refund.

We may withhold your payment until you have received the item or until you provide us with proof of return, whichever event occurs first.
Send back or hand over the item to us without delay and in any event not later than 14 days from the day on which you informed us of your withdrawal from this contract.
The deadline is met if you send the item back before the expiry of the 14-day period.
You must bear the direct costs of returning the item, do not send a parcel on delivery (we will not accept such parcels).
You are only liable for any diminution in the value of the item resulting from your use of it other than what was necessary to ascertain the nature, characteristics and functioning of the item.

§2 INFORMATION ON THE DECLARATION OF WARRANTY BY THE CONSUMER (COMPLAINTS).

In accordance with the applicable legislation, we are liable to you under the terms of the Civil Code for physical and legal defects.

You have the right upon discovery of a defect to:

a. make a declaration requesting a price reduction;
b. declare a withdrawal from the contract, but not if the defect is insignificant;
c. demand that the item be replaced with a defect-free item;
d. demand removal of the defect.

We will respond to your statement or demand within 14 days.

Withdrawal form

Deliver the defective item to the address (Przedsiębiorstwo Handlowe EWIMAX Stasiński Mariusz Jana Kasprowicza 24, 64-330 Opalenica).

We will bear the costs of replacement or repair, except if the defective item has been installed. In that case, you will bear part of the associated costs in excess of the price of the item. You may alternatively demand that we pay part of the costs for dismantling and reinstalling, but up to the price of the thing sold.

We shall be liable under the warranty if a physical defect is established before the expiry of two years from the delivery of the item or, if the item was sold used, one year from its delivery. Your entitlement is limited to a period of up to one year from the date the defect was established, but not before two years have elapsed since the delivery of the goods or, in the case of a second-hand item, before one year has elapsed since the delivery of the goods. An exception to this is if the expiry date specified by us or the manufacturer expires more than two years after delivery. In this case, we shall be liable under warranty for any physical defects of the item identified before the expiry of this period.

Liability for legal defects is essentially the same, with the time for filing a claim running from the moment we become aware of the defect and the limitation periods running from the time the ruling on the legally defective item becomes final.

The issue of warranty is extremely complex and we encourage you to consult the Civil Code and the websites of the OCCP and consumer organisations describing your rights in detail and illustrating them. Our shop operates in accordance with the law and respects consumer rights, so the legal information you will find there will also apply to your contracts with us.
